Texas shooting burros, stirring backlash

Unofficially, the state of Texas celebrates donkeys and their historical and cultural significance in shaping the American West.

Officially? The policy on wild burros out here is shoot to kill.

Texas park rangers are trying to wipe out hundreds of free-roaming donkeys in Big Bend State Park, killing nearly 130 to date with .308-caliber bolt-action rifles on this side of the Rio Grande. But in the process, the shootings are stirring a whole new kind of cross-border controversy, pitting state officials against burro-lovers who believe the animal holds a special place in history and deserves protection.

The state's stance: wild donkeys wandering over from Mexico simply don't belong. The Texas Parks and Wildlife Department considers an estimated 300 burros in Big Bend to be destructive intruders, hogging forage and lapping up precious water in the drought-starved mountains ? thereby threatening the survival of hundreds of native species.

Outraged locals, however, claim there's only one animal the state is really cares about ? bighorn sheep.

"They say we're doing this just so four rich white guys can hunt bighorn sheep out here," said David Riskind, director of natural resources for the parks agency. "That's just not true."

Once extinct in Texas for decades, bighorns made a heralded homecoming to Big Bend last year when a herd of nearly four dozen was relocated to the 316,000-acre range. But even that's not big enough for what the state says are foreign burros and the native bighorns.

Skeptics suspect the state's stance is all a wink to wealthy and well-connected hunters. Coveted state permits to bag bighorns fetch upward of $100,000 at auction in Texas, and opponents like Margaret Farabee of the of the Wild Burro Protection League believe that's why the state wants to eliminate any threat to the sheep's survival so the bighorn hunters can one day return to Big Bend.

Riskind said it will take decades before the bighorn population is robust enough to possibly allow hunting in Big Bend, but that doesn't quiet the doubts of a growing campaign to save the burros ? for a second time.

Among those trying to stop the shootings include a Wisconsin woman who's bombarded the state with open records requests; a former state park supervisor in Big Bend; and more than 94,000 supporters on Change.org, making it one of the website's most popular petitions ever.

But their biggest ally may be history. In 2007, a similar uproar caused the state to temporarily suspend its first foray into "lethal control" after parks rangers killed 71 wild burros.

Luis Armenderiz, the former Big Bend supervisor who retired following the initial controversy, said the burros are no more destructive to the park than humans who put in bike trails.

"We are invading their ecosystem. They're not invading ours," Armenderiz said.

Shooting wild animals doesn't generally create much of a stir in Texas, where hunting is a celebrated pastime. A year ago, Gov. Rick Perry famously paused from a morning jog to take aim at a coyote. This past summer, state lawmakers made gunning down feral hogs from helicopters legal.

No one sticks up for the ugly, rooting, beastly feral hog. So why the burro backlash?

"They're charismatic," Riskind said.

Opponents say the reasons are cultural. Donkeys did the dirty work of hauling supplies during America's westward expansion in the 1800s, and here along the border, families owned burros like households today have dogs. When the peso was weak, Mexican families strapped American-bought microwaves to their burro's backs to haul across the Rio Grande.

Even at Big Bend National Park, right next door to the state-owned land, killing wild burros is prohibited by a 40-year-old federal ban that Congress said protects the "living symbols and pioneer spirit of the West."

Riskind is quick to call burros "historically significant" and said the state tells the animal's important legacy through its books and museums. But he said those creatures were domesticated donkeys ? and times have changed.

Heightened border security has made walking a donkey across the Rio Grande nearly impossible, and Mexico's violent drug war has decimated small towns in northern states and sent families fleeing inward. Riskind said many of the wild burros in Big Bend today were simply abandoned by Mexican ranchers.

The donkey dust-up is playing out in an isolated, rugged region that looks like a stock Texas landscape in some old western shoot-'em-up. Residents proudly call it the Lone Star State's last frontier, but attitudes here lean more progressive than small-town rustic.

An hour up the road is Marfa, the arty desert oasis where Led Zeppelin frontman Robert Plant played a surprise show last month. In nearby Alpine, ranchers who drive into town to buy hay bales and horse feed drive past two yoga studios. Rachael Waller, who runs an equine rescue in Alpine, hands out "burro-friendly store" stickers to shop owners and said nearly every business in town is on board, including the local taxidermist.

Waller, who is the daughter of Robert Waller, author of "The Bridges of Madison County," has a 7-year-old burro named Penny on her 40-acre ranch.

"We like going to Big Bend and seeing all the wildlife. It's all supposed to be there," she said.

Riskind described "lethal control" as a reluctant but necessary measure of last resort. Park rangers don't actively hunt for burros, and pull the trigger only when they stumble upon a herd. Conservancy groups tried trapping the burros in 2007 after the state backed down to protesters, but spent months without wrangling one donkey from the impossibly rocky terrain.

For now, Riskind doesn't see the state giving into opposition again.

"I think it's safe to say we're not re-evaluating," he said.

China defines terrorism to win global support (AP)

BEIJING ? China's legislature authorized new guidelines Saturday to define and combat terrorism, inching closer to international practices as the nation grapples with a sporadically violent rebellion in Central Asian border lands.

The resolution clearly sets China's legal definition of terrorism and the steps for formally declaring groups and individuals terrorists and for freezing their assets. The measure should help law enforcement prosecute terrorists differently from other criminals and to promote international cooperation on terrorism, said Li Shouwei, a criminal law expert for the legislature.

"Our country faces a real threat from terrorist activities, and the long-term, complex and sharp counterterrorism struggle is increasingly prominent," Li told reporters after the legislative session.

Separatist sentiment among Uighurs, a Turkic and traditionally Muslim ethnic group, in China's western Xinjiang region has occasionally erupted in riots, bombings and other acts of violence. Despite pouring in billions of dollars in investment and the migration of millions of Han Chinese into the largely poor, remote territory, China has been unable to squelch the violence. A raid on a police station and an arson-stabbing attack took place in July.

Many attacks seem unsophisticated and directed against symbols of Chinese government power, like court houses or troop barracks. The government and some security experts say that the violence is becoming more indiscriminate and is being carried out by militants trained and based across the border in Pakistan and with possible links to other radical Islamic groups.

"Increasingly the Chinese government has realized it must work with international partners to fight the existing terrorist threat to China," said Rohan Gunaratna, a terrorism expert at Singapore's Nanyang Technological University.

While Beijing has sought for much of the past decade to link the situation in Xinjiang with the broader U.S.-led efforts to fight jihadist groups, Chinese methods have often undercut its quest for wider support. Instead of prosecuting Uighurs as terrorists, authorities have preferred to accuse them of "endangering national security," charges frequently used against political dissidents.

Beijing has also restricted the practice of Islam and bandied the terrorist label against the Dalai Lama and supporters of the Tibetan Buddhist leader who oppose Chinese rule.

In a measure of its uneasiness with Beijing, the U.S. government refused to turn over Uighurs captured in Afghanistan and interned at Guantanamo Bay, though it repatriated the captured nationals of many other countries.

Pakistan, which abuts Xinjiang and is a long-term ally of China, generally assists Beijing in trying to clamp down on militant Uighur separatists. But the most radical groups, the Turkistan Islamic Party and its East Turkistan Islamic Movement offshoot, operate in Pakistan's tribal areas where Islamabad is unable or unwilling to act.

Gunaratna, the terrorism expert, said Beijing realizes it needs intelligence from Gulf coast countries, Germany and others to better deal with the Uighur threat.

The terrorism resolution is intended to bridge gaps between China and other countries. It defines terrorism as an act whose "goal is to create terror in society, harm public security or threaten national institutions and international organizations and by using violence, sabotage, intimidation and other methods to cause or intend to cause human casualties, great loss to property, harm to public infrastructure, chaos to the social order and other severe social damage."

Li, the criminal law expert, said the definition roughly aligned with those of other countries. Agencies involved in counterterrorism will apply that definition to determine which groups or individuals should be placed on terrorist lists, and once listed the government will freeze their assets, according to the resolution.

More importantly, Li said, the resolution helps to make sure that terrorists are charged as such and not with other crimes ? an apparent reference to the prevailing practice of using state security charges instead of terrorism.

"By defining terrorist activities more clearly in regulations, it makes it easier to distinguish in practice terrorist crimes from other crimes," Li told reporters.

The measure itself is unlikely to end all differences. A host of government agencies, Communist Party bodies and the military are involved in counterterrorism and Xinjiang. Li suggested that differences among competing bodies meant that "the time is not mature for enacting a full counterterrorism law."

SAN DIEGO ? San Diego Chargers Pro Bowl left guard Kris Dielman suffered a grand mal seizure on the flight home Sunday after sustaining a concussion in a loss to the New York Jets, a person with knowledge of the situation said Thursday.

The person, who spoke to The Associated Press on condition of anonymity because the team doesn't release specific injury details, said an ambulance met the team plane and Dielman was hospitalized overnight. The person said the seizure occurred during the plane's descent into San Diego.

The 320-pound Dielman was staggered by the injury early in the fourth quarter but continued to play. The Chargers were out of offensive linemen due to other injuries.

Dielman, a four-time Pro Bowler known for his hard-nosed demeanor, declined to comment on the seizure. He did say he won't play in Monday night's game at Kansas City, "pretty much off of what I feel." He said he has lingering headaches.

"It's just one of those plays. I banged my head a little bit, and now I've got to deal with it," Dielman said.

Dielman missed one game last year due to a concussion. Coach Norv Turner said Dielman has yet to take the test he needs to pass before returning to practice. Dielman is scheduled to see a specialist Friday.

"You've got to tread lightly. We'll take the proper precautions and see what happens," Dielman said. "It (stinks). I was having a good year and this team's having a good year and I want to be part of this good season."

Dielman "is a great player and he sets the tempo for us," Turner said. "We've obviously gone through this with a lot of different guys, a lot of different positions, so we've got a plan. I think we'll be fine."

Tyronne Green is expected to start in Dielman's place.

Left tackle Marcus McNeill had limited participation in Thursday's practice because of a neck injury. He said he'll be OK to play Monday night. Tight end Antonio Gates, who returned Sunday after missing three straight games with plantar fasciitis in his right foot, practiced Thursday and is expected to play at Kansas City.

The defending AFC West champion Chiefs (3-3) have won three straight games since a 20-17 loss to the division-leading Chargers (4-2) on Sept. 25.

Researchers complete mollusk evolutionary tree

Mollusks have been around for so long (at least 500 million years), are so prevalent on land and in water (from backyard gardens to the deep ocean), and are so valuable to people (clam chowder, oysters on the half shell) that one might assume scientists had learned everything about them.

"Here's this big, diverse group of animals, and we don't know how they were related to each other," said Casey Dunn, an evolutionary biologist at Brown University who specializes in building evolutionary trees. Some branches were well known, Dunn said, "but what we really lacked was a breadth of sampling."

In a paper in Nature, researchers from Brown and collaborating institutions have pieced together the most comprehensive phylogeny -- evolutionary tree -- for mollusks. To perform that feat, the team collected hard-to-find specimens through a global sampling effort, including a group of organisms thought until recently to be extinct for millions of years. The team then sequenced thousands of genes from the specimens and matched them up through intensive computational analyses involving the supercomputer at Brown, which the University installed in 2009.

The result: The mollusk phylogeny is now "resolved at a broad scale," said Dunn, assistant professor of biology in the Department of Ecology and Evolutionary Biology and the paper's corresponding author.

The study is noteworthy also because it is the first to place Monoplacophora, the mysterious group of deep-ocean animals that superficially resemble limpets. Scientists had thought the group was extinct until a specimen was caught in 1952 off the coast of Mexico. An expedition in 2007 led by Nerida Wilson, now at the Australian Museum and an author on the current paper, secured a few monoplacophorans off the coast of California. The team extracted the genetic material -- in a one-time-only attempt performed by then-Brown undergraduate Caitlin Feehery -- to obtain the genetic signatures needed to determine how monoplacophorans fit into the mollusk family tree.

The result was surprising: monoplacophorans are a sister clade to cephalopods, which encompasses octopuses, squid, and nautiluses. "Cephalopods are so different from all other mollusks, it was very difficult to understand what they are related to. They don't fit in with the rest," Dunn said. "Now, we have a situation where two of the most enigmatic groups within the mollusks turn out to be sister groups."

In an interesting twist, paleontologists had described the monoplacophoran-cephalopod relationship in the 1970s, resting their claim on evidence that the oldest cephalopods and fossilized monoplacophorans each had chambered shells. Modern-day monoplacophorans still carry shells but no longer have chambers. "When we came in with this genome-level data, we ended up resurrecting this old hypothesis from paleontology," Dunn said. The results from the genetic analysis show the paleontologists were right.

By establishing the close evolutionary relationship between monoplacophorans and cephalopods, the researchers say they have squarely answered the question of a single origin for shelled mollusks. That ancestor species is not known, but the group is confident that monoplacophorans and cephalopods share more in common, evolutionary speaking, with shelled mollusks than with the non-shelled groups aplacophora and polyplacophora.

"What we found is these worm-like mollusks (aplacophora) and chitons (polyplacophora) are more closely related to each other, and they diverged prior to the origin of the shell," Dunn said. "They are mollusks, but they formed this group that split off before shells came along."

In all, the team collected specimens for 15 species. Researchers at Brown and Harvard University sequenced hundreds of thousands of gene sequences and compared those genetic sequences with what is known about the genetic makeup of other species throughout the mollusk tree.

"We are trying to understand how these species are related, their evolutionary relationships. We do this by analyzing the conserved parts of their genomes and constructing an evolutionary tree," said Stephen Smith, a postdoctoral researcher at Brown and the paper's first author, who designed the genetic computational analysis.

Hilo tour company suspends zip line tours

A Hilo-based eco-tourism company says it has suspended booking zip line tours until the cause of a fatal accident is fully understood.

Ted Callaway of Lahaina and a co-worker were in the process of testing a zip line north of Hilo last month when a tower collapsed and Callaway plunged 200 feet to his death. His co-worker Curtis Wright, of Miamisburg, Ohio, was critically injured.

The course has been closed since the incident. KapohoKine Adventures said Monday it halted booking all zip line tours pending a full evaluation of soil composition and structural integrity of the lines.

The Hawaii Occupational Safety and Health division is conducting a workplace death investigation.

Bruce Willis and Emma Heming: Expecting!


Bruce Willis may be pissed at Ashton Kutcher for allegedly cheating on Demi Moore, but the action star still found time recently to impregnate his wife.

The star's rep confirmed today in a statement that Willis and wife Emma Heming are expecting their first child - Bruce's fourth overall - early next year.

The celebrity and the designer/model are "overjoyed with this news and they look forward to welcoming this newest addition into their family," the rep said.

Willis and Moore, of course, are the parents of three fairly well-known kids: Rumer, 23, Scout, 20, and Tallulah, 17. He married Heming in March 2009 and will soon anchor Die Hard 5.

From iPhone 4S Photo to 3D Model

iPhone 4S photoAs you know I am a huge Project Photofly freak as the technology to capture photos from a digital camera and transform them in to 3D models is a game changer. There are several solutions out there but nothing comes even close to the free technology Project Photofly preview hosted on Autodesk Labs. You can take photos using your point and shoot camera or DSLR then upload in Project Photofly and you get a 3D textured model and that can be exported to many industry formats or even a video to YouTube.

I was one of the people that was eligible for a phone upgrade and brought down the Internet with preordering the iPhone 4S. The iPhone 4S has all new optics and the best on a mobile device. Were the all new camera optics the main reason I was upgrading my iPhone 4 to the 4S, without question.

The photos this iPhone 4S captures are quit remarkable. I used testing it as an excuse to go fishing in the high Uinta mountains Mirror Lake. Mirror Lake with 4S
So naturally one of the first things I was gong to do besides talking to Siri was take some photos and see how well they worked to generate 3D models in Photofly.

The results were nothing less than awesome.

I just created a quick image showing the statue I photographed with my iPhone 4S and then automatically it generated without any manual intervention a 3D? model. This took minutes and even though I am a 3D modeling ninja, there is no way I could accurately to scale this statue complete as a mesh with textures any other way.

I also created an automatic video to YouTube using the automatically generate camera path option. I could have manually defined the key frames but I wanted a fully automatic from photo to 3D model.

BPA in pregnant women might affect kids' behavior (AP)

CHICAGO ? Exposure to the chemical bisphenol-A before birth could affect girls' behavior at age 3, according to the latest study on potential health effects of the compound used in the manufacturing of some plastic drink bottles and food can linings.

Preschool-aged girls whose mothers had relatively high urine levels of BPA during pregnancy scored worse but still within a normal range on behavior measures including anxiety and hyperactivity than other young girls.

The results are not conclusive and experts not involved in the study said factors other than BPA might explain the results. The researchers acknowledge that "considerable debate" remains about whether BPA is harmful, but say their findings should prompt additional research.

The researchers measured BPA in 244 Cincinnati-area mothers' urine twice during pregnancy and at childbirth. The women evaluated their children at age 3 using standard behavior questionnaires.

Nearly all women had measurable BPA levels, like most Americans. But increasingly high urine levels during pregnancy were linked with increasingly worse behavior in their daughters. Boys' behavior did not seem to be affected.

The researchers said if BPA can cause behavior changes that could pose academic and social problems for girls already at risk for those difficulties.

"These subtle shifts can actually have very dramatic implications at the population level," said Joe Braun, the lead author and a research fellow at Harvard's School of Public Health.

For every 10-fold increase in mothers' BPA levels, girls scored at least six points worse on the questionnaires.

The study was released online Monday in Pediatrics.

Linda Birnbaum, director of the National Institute of Environmental Health Sciences and the National Toxicology Program, said the study contributes important new evidence to "a growing database which suggests that BPA exposure can be associated with effects on human health."

Grants from that federal agency helped pay for the study.

The Food and Drug Administration has said that low-level BPA exposure appears to be safe. But the agency also says that because of recent scientific evidence, it has some concern about potential effects of BPA on the brain and behavior in fetuses, infants and small children. The FDA is continuing to study BPA exposure and supports efforts to minimize use in food containers.

BPA has many uses, and is found in some plastic bottles and coatings in metal food cans. It was widely used in plastic baby bottles and sippy cups but industry phased out that use.

Braun said it's possible that exposure to BPA during pregnancy interferes with fetal brain development, a theory suggested in other studies, and that could explain the behavior differences in his study. Why boys' behavior wasn't affected isn't clear. But BPA is thought to mimic the effects of estrogen, a female hormone.

The researchers evaluated other possible influences on children's behavior, including family income, education level and whether mothers were married, and still found an apparent link to BPA.

But Dr. Charles McKay, a BPA researcher and toxicologist with the Connecticut Poison Control Center, said the researchers failed to adequately measure factors other than BPA that could explain the results.

For example, there's no information on mothers' eating habits. That matters because mothers' higher BPA levels could have come from eating lots of canned foods instead of healthier less processed foods, which might have affected fetal brain development.

The American Chemistry Council, a trade group whose members include companies that use BPA, said the research "has significant shortcomings ... and the conclusions are of unknown relevance to public health."

Florida senator denies embellishing family history (AP)

MIAMI ? In Florida, where Cuba and Fidel Castro can be highly combustible political issues, Republican Sen. Marco Rubio is defending himself against allegations he embellished his family's story in saying his parents left the island after Castro came to power.

So far, prominent members of the Cuban American community are standing by him, including the head of one of Miami's oldest and most respected exile groups, who said Friday that he is willing to give the rising GOP star and tea-party favorite a pass.

The 40-year-old freshman senator has always publicly identified with the exile community and has a strong following within it. In a campaign ad last year, he said: "As the son of exiles, I understand what it means to lose the gift of freedom." Rubio's biography on his Senate website previously said he was "born in Miami to Cuban-born parents who come to America following Fidel Castro's takeover." It has been changed to say Rubio "was born in Miami in 1971 to Cuban exiles who first arrived in the United States in 1956."

But The Washington Post reported that Rubio's parents actually left Cuba in 1956, nearly three years before Castro seized power in a revolution against dictator Fulgencia Batista. Rubio's father was a store security guard when he and his wife left, according to Rubio's staff, and came to the U.S. for economic reasons.

Rubio responded to the story with a statement saying his parents had tried to return to Cuba in March 1961 but quickly left because they did not want to live under communism.

"After arriving in the United States, they had always hoped to one day return to Cuba if things improved and traveled there several times," he said. "In 1961, my mother and older siblings did in fact return to Cuba while my father stayed behind wrapping up the family's matters in the U.S. After just a few weeks living there, she fully realized the true nature of the direction Castro was taking Cuba and returned to the United States one month later, never to return."

In addition, Rubio has said publicly on previous occasions that his parents left Cuba before the revolution.

Rubio's staff said it would change his Senate website.

The issue is magnified because of the formidable political clout of the Cuban exile community in Florida and the fierce passions in Miami that still surround Castro and the communist island, and because Rubio is often mentioned as a potential vice presidential pick. Republican presidential candidates Mitt Romney, Michele Bachmann and Newt Gingrich have said he would make a great running mate.

Democrats are trying to make an issue of it, saying it calls into question Rubio's character. The Florida Democratic Party accused Rubio of "self-serving deception," and the Democratic Senatorial Campaign Committee said Rubio has a credibility problem.

"The latest bombshell confirms that Rubio seriously struggles to tell the truth and can't be trusted," said DSCC spokesman Matt Canter.

But Sean Spicer, a spokesman for the GOP National Committee, said the attacks will only strengthen Rubio by causing Republicans to come to his defense. The conservative was elected in 2010 after an upset over the GOP establishment's choice, Gov. Charlie Crist.

"There's no question he has an amazing life story. His family came here to pursue a better life, and that is all accurate. There's folks out there who have seen a great success story and are plotting to figure out how to take him down," Spicer said.

The head of the Miami-based Cuban American National Foundation, Pepe Hernandez, himself an exile and longtime opponent of Castro, said Rubio's parents' initial departure date was unimportant.

"There were a number of people who came here during the Batista regime because they were against Batista somehow," he said. "Then they returned to Cuba when Castro came in because they thought now things were going to change, and then after some time they realized this was not going to happen."

"Maybe their case is not exactly the same. They really came here as immigrants, but the second time the reason was that they couldn't live in Cuba under those circumstances. I don't see any difference between his parents and myself and everyone else who came here."

Former Sen. Mel Martinez, R-Fla., who left Cuba as a teenager after the revolution, said the Post story showed "a gross lack of understanding about the Cuban exile experience. The fact is that they would not have left Cuba permanently if not for extreme fear of persecution and in search of freedom, like so many of us did."

Fernand Amandi, a pollster whose company specializes in Hispanic public opinion and works more often with Democrats than Republicans, said the episode alone might not be that damaging, but it could invite further scrutiny of Rubio's record.

"It's a chink in his armor of what was somebody who up to this point had almost uniformly positive and favorable coverage," he said.

2 more teens under protection in Pa. basement case (AP)

PHILADELPHIA ? Philadelphia police took two more children into protective custody Wednesday, the latest step in an intense investigation of four people accused of locking disabled adults in a dank basement as part of a Social Security fraud scheme.

Meanwhile, police in Virginia confirmed they investigated the 2008 death of a woman living with the alleged ringleader, Linda Ann Weston, who cleared out of the Norfolk home hours after calling police about the death.

A Virginia death certificate said 39-year-old Maxine Lee died of meningitis but also suffered from a wasting disease.

In Philadelphia, police told reporters that a malnourished niece living with Weston had burn marks suggesting the 19-year-old was burned with a hot spoon and had pellet gun wounds.

"I've never seen anything like this before in a living person. It is just remarkable that she is alive," Police Commissioner Charles Ramsey said of Beatrice Weston.

"There is no penalty, and I repeat, no penalty that is too harsh for the people who did this," he said.

In all, eight juveniles and four young adults between the ages 2 to 19 linked to the case have been taken into protective custody.

Police spokesman Lt. Raymond Evers said they are conducting DNA tests and obtaining birth certificates to try to determine the nature of the various relationships.

Earlier Wednesday a fourth suspect, Jean McIntosh, 32, the daughter of alleged ringleader Linda Weston, was arrested by police.

She, along with Weston, Gregory Thomas, 47 ? whom Weston described as her boyfriend ? and Eddie "the Rev. Ed" Wright, 50, have been charged with kidnapping, false imprisonment and other charges.

None of the four could be reached for comment, and efforts to contact Weston's lawyer were not successful.

The case could be among the first of its kind prosecuted as a federal hate crime, an FBI official who was not authorized to discuss the case publicly told The Associated Press on condition of anonymity.

Landlord Turgut Gozleveli discovered the victims after he heard dogs barking in the basement. The door to the basement room was chained shut, but Gozleveli got inside and lifted a pile of blankets to find several sets of eyes staring back at him. One man was chained to the boiler.

Police identified the victims as Derwin McLemire, 41, of North Carolina; Herbert Knowles, 40, of Virginia; and Tamara Breeden, 29, and Edwin Sanabria, 31, both of Philadelphia.

Ramsey said the case has multiple threads in multiple jurisdictions.

"This is unfolding," he said. "These are folks who have gone through an awful lot."

'Ramped' up 'Fear Factor' returns Dec. 12

Expect huge explosions on "Fear Factor" this December.

Get ready for a bigger and crazier version of "Fear Factor."

NBC announced today that the competition show is set to return on Dec. 12 at 8 p.m., and not only that, the program will be more outrageous than before.

"We have taken the groundbreaking ?Fear Factor? franchise that many fans remember fondly and have ramped it up to make it even more challenging and competitive than ever before,? said Paul Telegdy, president of alternative and late-night programming at the network. ?Once again, the contestants will have to face their ultimate fears to prevail -- and the tension and drama of that process will make for some riveting television.?

So how much bigger is it going to be? Expect some ginormous explosions, for starters. Executive producer Matt Kunitz said that the return of the show will use technology that the original version of the program wasn't able to, according to a June report by The Hollywood Reporter. Today's statement noted that viewers can expect stunts titled "Towering Inferno" and "Helicopter TNT Crash."?

Each episode of the?show will pit four teams of two who will be competing against each other. The reboot will be hosted by Joe Rogan, who also performed the same duties for the original version of the show.

And baby makes three ... three kids in Mariska Hargitay's family, that is. The "Law & Order: SVU" actress adopted baby son Andrew shortly after bringing home daughter Amaya, People?reports. Andrew and Amaya join Hargitary and husband Peter Hermann's first child, son August.

The second adoption happened swiftly; within a week of processing the paperwork for Amaya, the couple brought home Andrew, who was born over the summer.

?We never in a million years thought it would happen this quickly, but something inside of us knew that this was right, and we said, ?Yes, yes, yes!?? said Hargitay. ?We knew this was our guy. Everything about it felt right. It felt divinely right.?

Hargitay is going to continue to work on "Law & Order" four days a week.

With his unexpected rise in the 2012 GOP presidential polls, former businessman Herman Cain is suddenly a hot topic. And MSNBC ?Morning Joe? host Joe Scarborough?took a few shots at him on his Tuesday morning show. Scarborough?s criticism focused on Cain?s signature ?9-9-9? tax plan.

Scarborough co-host Mika Brzezinski cited a Nov. 22, 2010 Cain op-ed that appeared on The Daily Caller website, in which Cain argued against a national sales tax ? an idea which is now a component of the ?9-9-9? plan.

?That?s exactly what your good friend Grover Norquist said when he was here the other day,? Scarborough exclaimed. ?He said it?s not sticking three needles in your arm. And that they can draw blood from three separate needles. So if you have these three sources of tax revenue, trust me, trust me. trust Mark Halperin, trust us all. If you give Congress a national sales tax, 9 is going to 11 is going to be 15 is going to be 20.

?And, by the way, he?s not getting rid of the income tax. He?s not getting rid of the business tax. So yeah, he opposed his own plan 11 months ago.?

Scarborough also took aim at Cain?s remarks about erecting an electric border fence, chiding Brzezinski, a Democrat, for her own hand-wringing on the subject.

?You shouldn?t be concerned,? Scarborough told her. ?It?s not even your party. By the way, he hasn?t backed down from that. This is ?exhibit 800? over the past year of why my Republican Party has lost their way in such a serious, serious way. We laugh about it, but it is actually tragic.?

Will Evangelicals Doom Mitt Romney? (Time.com)

Mitt Romney 2.0 is an impressive candidate. While other Republicans have moved up and down in the polls, he has held the position of frontrunner for most of the past year and a half. Compared with the last presidential race, he?s looser and more sure of himself. Heck, during the Tuesday?s debate in New Hampshire, Romney was feeling confident enough to crack a joke at the expense of Charlie Rose. And it was funny! The former governor may not inspire passion in voters, but he exudes competence, which may be the more valuable trait in this election when the economy is faltering and Obama is so weak.

Yet, for all his strengths, Romney can?t seem to broaden his appeal beyond a quarter of the Republican electorate. Despite his commanding debate performances and general election promise, his support in primary polls has rarely surpassed 26%, which is close to where he peaked in 2008. He does not pick up new backers when support for opponents like Rick Perry or Michele Bachmann fades. So, what?s going on?

It?s the evangelicals, stupid.

Religious conservatives have always harbored suspicions about where Mitt Romney?s true feelings lie on social issues after he ran to the left in Massachusetts, then far to the right in 2008, and now seems to be settling somewhere closer to center-right. The bigger problem for Romney is that this ideological and characterological problem is overlaid on a theological one. As we were reminded by an unusually public statement by Pastor Robert Jeffress at the recent Values Voters Summit, many evangelical and fundamentalist Christians do not consider Mormons to be Christians.

That belief can influence the way evangelicals vote. Most Americans (68%) say a Mormon candidate?s faith makes no difference to them. But in a Pew Research survey last spring, 31% of evangelical Republicans and Republican-leaning independents said they would be less likely to vote for a Mormon. Only 15% of non-evangelical Republicans felt the same way. Those numbers are unchanged from 2007, when Romney first ran for the GOP nomination.

Evangelical aversion to Mormons wouldn?t be such a problem for Romney if he could build a winning coalition without them. But historically, that?s been hard to do in GOP primaries. Sixty percent of voters in the Iowa caucuses and the South Carolina primary in 2008 were evangelicals. And Tea Party supporters, who are among the most energized in this campaign season, overwhelmingly identify themselves as ?Christian conservatives?, according to the Public Religion Research Institute.

In 2009, religion researchers John Green and Mark Silk ran a simulation to predict how Romney would have performed in the 2008 primaries if evangelicals had simply voted the same way as other Republicans. The result of their simulation? Romney would have won across the South, including the key state of Florida, and he would have even taken Iowa. In other words, he would have been the nominee.

Romney?s shifting ideological profile hasn?t done much to allay evangelical concerns about Mormonism. As Green and Silk put it in their analysis, ?Just as people who change positions are deemed untrustworthy because they claim to be something they?re not, so, in evangelical eyes, Mormons claim to be something they?re not; namely, Christians.? In December 2007, Romney gave a speech in Texas intended to put to rest questions about his faith. But his remarks, which mentioned his belief in Jesus Christ and emphasized the parts of his faith that conform with mainstream Christianity, only made things worse for those evangelical Christians who believed he was just being slippery.

A poll conducted earlier this month by the Barna Group underscored evangelical skepticism about Romney?s character. Pollsters asked Americans to rate Obama, Romney and Perry on character traits like leadership, honesty, intelligence and philosophy of government. Perhaps unsurprisingly, evangelicals rated Perry highest in all categories. But they also rated Obama higher than Romney in every category except for leadership.

Even so, Romney and evangelicals are not irreconcilable. A new TIME poll shows him outperforming Perry with that group in a general election matchup against President Obama. Bryan Fischer, an outspoken critic of Mormonism who spoke at the Values Voters Summit, told reporters afterward that ?If the choice was between Barack Obama and the other guy, I?d vote for the other guy.? And in a Bloggingheads conversation last month, Richard Land of the Southern Baptist Convention told me that evangelicals are fired-up to remove Obama from the White House. ?I have never seen the grassroots of evangelicalism and conservative Catholicism more energized than they are right now,? Land said. ?I?ve heard on more than one occasion, pastors say to me, Richard, this is the most important election in America since 1860.?

If Romney can win the Republican primary, most evangelical Christians will vote for him in the general election. But he?s not the nominee yet, and both his opponents and conservative evangelical activists intend to do everything in their power to stop him. After all, they?ve done it before.

(AP) ? Jon Huntsman is betting big on New Hampshire as his presidential campaign struggles to survive.

Two weeks have passed since the former Utah governor moved his national headquarters to New Hampshire. Despite what some aides say, it was a move of necessity, not preference.

The campaign is shedding staff by the dozen. Poor fundraising numbers become public this weekend. And Huntsman, the Obama administration's former ambassador to China, is barely registering on national polls.

Lacking the money to run television ads, he's relying upon shoe leather.

Huntsman hosted seven New Hampshire town halls last week. That's more New Hampshire town halls in one week than most of his rivals hosted all year. And he plans to boycott Tuesday's debate in Nevada in favor of staging another New Hampshire gathering.

NEW YORK ? The New York Giants were aware that defensive tackle Jimmy Kennedy faced a possible suspension for violating the NFL's policy on performance-enhancing substances when they signed him in August.

Coach Tom Coughlin made the disclosure on Wednesday, a day after the NFL suspended Kennedy for four games for violating its policy on performance-enhancing substances.

Coughlin said the Giants thought about not signing Kennedy, but opted to put him on the team.

"Jimmy Kennedy, in all that he has done with me, has conducted himself as a pro," Coughlin said. "He has done things in the best interest of the club and I am going to give him the benefit of the doubt and say that if this occurred it's a one-time thing and let's get it over and done."

Kennedy had four tackles in five games this season. He is eligible to return to the active roster the day after the Giants face the San Francisco 49ers on Nov. 13.

The former Penn State star was selected by St. Louis with the 12th overall pick in the 2003 draft. He played for the Rams, Broncos, Bears, Jaguars and Vikings during his first eight seasons in the league.

Kennedy has 8 1/2 sacks and 31 starts in 91 career games.
